TRADEMARK CERTIFICATE

1. Scope of Service

Rexobe Consult Ltd provides trademark registration services on behalf of clients, acting as a facilitator and filing agent. Our services cover:

• New trademark application and registration with the Trademarks, Patents and Designs Registry under the Federal Ministry of Industry, Trade and Investment
• Trademark search and availability check
• Renewal of existing trademarks
• Amendment/update of trademark records
• Advisory on trademark classification and registration requirements

2. Trademark Search & Availability

2.1 Prior to filing, Rexobe Consult Ltd will conduct a trademark search on the client’s proposed mark to check for existing similar or identical marks on the Registry.

2.2 A search result indicating availability does not constitute a guarantee of registration approval, as the Registry conducts its own independent examination.

2.3 If the search reveals a conflicting mark, the client will be notified and required to decide on whether to proceed, modify, or withdraw their application. Any additional costs arising from modifications will be borne by the client.

2.4 Clients who choose to proceed with filing despite being advised of a potential conflict do so at their own risk, and no refund will be issued on that basis.

3. Trademark Classes

3.1 Trademark registration in Nigeria is class-based, in accordance with the Nice Classification system. Each application covers one (1) class of goods or services.

3.2 If a client requires registration under multiple classes, each additional class will attract a separate filing fee.

3.3 It is the client’s responsibility to confirm the appropriate class(es) for their goods or services. Rexobe Consult Ltd will provide guidance, but the final decision rests with the client.

3.4 Rexobe Consult Ltd shall not be liable for losses arising from registration under an incorrect class where the client was duly advised.

4. Required Documentation

4.1 Clients are expected to provide all necessary documents at the point of engagement. Standard requirements typically include (but may not be limited to):

• Clear logo/mark in the required format (high-resolution image where applicable)
• Description of goods or services the trademark will cover
• Valid means of identification of the applicant (individual or corporate)
• CAC registration documents (for corporate applicants)
• Power of Attorney (where applicable)

4.2 Additional documents may be required depending on the nature of the trademark or the Registry’s current requirements.

5. Payment Without Documentation

5.1 Clients who make payment without submitting the required documents are granted a grace period of two (2) months to provide all necessary documentation.

5.2 Failure to submit the required documents within this period will attract a monthly penalty of ₦2,150, applied at the end of each subsequent month until the documents are provided.

5.3 If there is a change in service pricing during this period, the client will be required to pay the difference between the original amount paid and the updated service fee.

6. Job Completion & Timeline

6.1 Trademark registration in Nigeria is a process that typically spans several months, and timelines are subject to the operational schedules of the Trademarks Registry and relevant government authorities.

6.2 The general process includes the following stages, each of which is controlled by the Registry:

• Filing
• Acknowledgement
• Examination
• Publication in the Trademarks Journal
• Opposition period
• Issuance of certificate

6.3 Rexobe Consult Ltd shall not be held liable for delays caused by Registry backlogs, examination queries, oppositions filed by third parties, or any other circumstances beyond our reasonable control.

6.4 Clients will be kept informed of significant milestones and developments throughout the registration process.

7. Opposition & Examination Queries

7.1 If the Registry raises an examination query on a filed application, Rexobe Consult Ltd will notify the client promptly. Responding to such queries may attract additional professional fees.

7.2 If a third party files an opposition against the client’s trademark application during the publication/opposition period, Rexobe Consult Ltd will notify the client. Handling of opposition proceedings is not covered under the standard registration fee and will be quoted separately.

7.3 Rexobe Consult Ltd shall not be liable for the outcome of opposition proceedings or Registry decisions.

8. Certificate & Document Handling

8.1 Upon successful registration, the trademark certificate will be delivered to the client via the contact details provided.

8.2 Clients are advised to keep and preserve all delivered certificates and documentation. Rexobe Consult Ltd will not be responsible for certificates lost after delivery.

8.3 Requests for retrieval or reissuance of previously delivered documents will attract applicable retrieval fees.

8.4 A registered trademark in Nigeria is valid for seven (7) years from the date of application and renewable for subsequent fourteen (14) year periods. It is the client’s sole responsibility to ensure timely renewal.

9. Partial Payment Policy

9.1 Clients who make a 70% partial payment are granted a grace period of two (2) months from the date of service completion to pay the outstanding balance.

9.2 Failure to settle the remaining balance within this period will attract a monthly penalty of ₦2,150, applied at the end of each month until full payment is made.

10. Refund Policy

10.1 Pre-Commencement Cancellation: If you cancel your project before we commence work, you will be entitled to a refund of the amount paid, less a 20% administrative fee. Refunds will be processed within three (3) weeks from the cancellation date.

10.2 Post-Commencement Cancellation: Once work has commenced, including conducting a trademark search, preparing filing documents, or making any payments to the Registry on your behalf, no refunds will be issued.

10.3 Unsuccessful Registration: Trademark registration fees paid to the Registry are non-refundable by the Registry. Accordingly, Rexobe Consult Ltd cannot offer refunds on government or Registry charges in the event of an unsuccessful application.

10.4 Cancellation by Rexobe Consult: In the unlikely event that we are unable to fulfil our obligations and initiate cancellation, we will refund the amount paid, less a 30% fee to cover costs already incurred.

11. Limitation of Liability

11.1 Rexobe Consult Ltd acts solely as a registration facilitator and filing agent. We are not responsible for the decisions, rejections, or queries issued by the Trademarks Registry or any other regulatory authority.

11.2 We do not guarantee the success of any trademark application, as approval is entirely at the discretion of the Registry.

11.3 We shall not be liable for any losses arising from inaccurate, incomplete, or misleading information or documents supplied by the client.

11.4 We shall not be liable for any infringement claims, disputes, or legal actions involving the client’s trademark brought by third parties.

12. Intellectual Property Acknowledgement

12.1 The trademark being registered remains the exclusive intellectual property of the client upon successful registration.

12.2 Rexobe Consult Ltd claims no ownership, rights, or interest in any trademark registered on behalf of a client.

12.3 Clients are advised to seek independent legal advice regarding the scope of protection, enforcement, and commercialisation of their registered trademark.

13. Agreement & Acceptance

13.1 By making payment for our trademark registration service, you confirm that:

• You have read, understood, and accepted these Terms and Conditions in full.
• All information, documents, and marks provided are accurate, authentic, and do not knowingly infringe on any existing trademark or intellectual property rights.
• You authorise Rexobe Consult Ltd to act on your behalf for the purposes of trademark search, filing, and registration activities.
